How to Prepare for Court Without a Lawyer in California

Representing yourself in court (called appearing “pro se” or “pro per”) is common and completely legal in California. Here’s how to prepare so you walk in confident.

Before Court Day

1. Know Your Case Inside and Out

  • Read every document in your case file
  • Understand the timeline of events
  • Know the relevant laws (or at least the key code sections)
  • Anticipate what the other side will argue

2. Organize Your Evidence

Create an organized folder or binder: – Tab 1: Your filed documents (petition, response, etc.) – Tab 2: Evidence supporting your case (chronological) – Tab 3: Any responses from the other party – Tab 4: Laws or code sections you’ll reference – Tab 5: Your notes and talking points

3. Prepare What You’ll Say

Write out your key points — not a script, but bullet points: – What happened (facts only, no opinions) – What you’re asking the court to do – Why you’re entitled to it – Key evidence that supports your position

Practice saying it out loud. Time yourself — aim for 3–5 minutes.

4. Make Copies

Bring 3 copies of everything: one for you, one for the judge, one for the other party.

Court Day

What to Wear

  • Business casual or professional attire
  • No flip-flops, shorts, tank tops, or hats
  • You don’t need a suit, but look like you take this seriously

What to Bring

  • ✅ Valid photo ID
  • ✅ Your organized evidence folder
  • ✅ Pen and notepad
  • ✅ All filed court documents
  • ✅ Copies for all parties
  • ✅ Phone (silenced — for reference only, no calls/texts)

What NOT to Bring

In the Courtroom

Addressing the Judge

  • Stand when speaking to the judge
  • Say “Your Honor” — not “Judge,” not “Sir/Ma’am”
  • Wait to be called before speaking
  • Answer questions directly — don’t ramble

Presenting Your Case

  1. When called, approach the podium or counsel table
  2. State your name and that you’re representing yourself
  3. Present your facts clearly and chronologically
  4. Reference your evidence — “Your Honor, I’d like to show Exhibit A…”
  5. Ask for what you want specifically

Golden Rules

  • Never interrupt the judge or the other party
  • Never argue with the other party directly — address the judge
  • Stay calm — anger and emotion hurt your case
  • Tell the truth — getting caught in a lie destroys your credibility
  • Be respectful — even if the other party is hostile

After the Hearing

  • The judge may rule immediately or take the matter “under submission” (decide later)
  • If you disagree with the ruling, ask about appeal options before leaving
  • Get copies of any orders signed
