Child Support: The Rules

It’s Not Optional

Child support is the child’s right — not the parent’s. Even if both parents agree to waive it, the court can still order it. You can’t bargain it away.

Formula-Based

California uses a mathematical formula (DissoMaster software) that considers: – Both parents’ incomes – Percentage of time each parent has custody – Tax filing status – Allowable deductions

Ends at 18 (Usually)

Child support ends when the child turns 18 or 19 if still in high school. There’s no automatic college support obligation in California.

Spousal Support: The Rules

It IS Optional

Spousal support can be waived by agreement (including in a prenuptial agreement). Not every divorce involves spousal support.

Discretion-Based

Unlike child support, there’s no formula for long-term spousal support. The judge weighs 14 factors including earning capacity, marriage length, standard of living, and more.

Temporary Duration (Usually)

The general rule is support for half the length of the marriage (marriages under 10 years). For marriages over 10 years, the court retains jurisdiction but still expects the supported spouse to become self-supporting.
