Common Questions
Can I split my claim into multiple cases?
No. California Code of Civil Procedure § 116.420 prohibits splitting a single claim into multiple smaller claims to fit within the limit. If your total claim against one party is $15,000, you can’t file two separate $7,500 cases.
Can I reduce my claim to fit the limit?
Yes. If you’re owed $15,000, you can waive the excess and sue for $12,500. You’d be giving up $2,500, but it may be worth it to avoid the expense and complexity of a regular civil lawsuit. You cannot recover the waived amount later.
What if my claim exceeds the limit?
You have three options: 1. Waive the excess and sue for the maximum in small claims 2. File in limited civil court (claims up to $35,000) — more complex, attorneys allowed 3. File in unlimited civil court (claims over $35,000) — most complex and expensive
