The Golden Rule
If it’s not documented, it didn’t happen. Judges decide based on evidence, not feelings or verbal claims. Everything you assert must be backed up by something tangible.
Types of Evidence by Claim
Contract Disputes
- ✅ Written contract or agreement (the original if possible)
- ✅ Text messages or emails confirming terms
- ✅ Invoices sent and payment records
- ✅ Proof of your performance (photos of completed work, delivery receipts)
- ✅ Communications showing the other party acknowledged the debt
Property Damage
- ✅ Photos of the damage (before and after if available)
- ✅ Repair estimates (get at least 2 from licensed contractors)
- ✅ Actual repair receipts
- ✅ Police report (for car accidents)
- ✅ Insurance correspondence
Security Deposit Disputes
- ✅ Move-in and move-out inspection reports
- ✅ Photos from move-in and move-out
- ✅ The lease agreement
- ✅ The landlord’s itemized deduction statement (or proof they didn’t provide one)
- ✅ Receipts showing you left the unit clean
Unpaid Services
- ✅ Contract or agreement for services
- ✅ Proof services were delivered (photos, emails, sign-offs)
- ✅ Invoices and payment demands
- ✅ Communications where the other party acknowledged the work
How to Organize Your Evidence
Create an evidence binder with: 1. Tab 1: Summary page — one page with the facts, dates, and amount claimed 2. Tab 2: Contract/agreement — the foundational document 3. Tab 3: Communications — chronological order (texts, emails, letters) 4. Tab 4: Financial records — invoices, receipts, bank statements 5. Tab 5: Photos/videos — printed with dates and descriptions 6. Tab 6: Witness statements — signed and dated 7. Tab 7: Your demand letter — proof you tried to resolve before suing
Make 3 copies: One for you, one for the judge, one for the defendant.
Witnesses
Witnesses can strengthen your case significantly: – They must have firsthand knowledge of the relevant facts – Written statements are acceptable but live testimony is stronger – Family and friends can testify, but the judge may give less weight to biased witnesses – Expert witnesses (contractors, mechanics) are powerful for damage/value disputes
