An uncontested divorce is the fastest, cheapest, and least stressful way to end a marriage in California. Here’s exactly how it works.

What Makes a Divorce “Uncontested”?

An uncontested divorce means you and your spouse agree on everything: – ✅ Division of property and debts – ✅ Spousal support (amount and duration, or waiver) – ✅ Child custody and visitation schedule – ✅ Child support amount – ✅ Any other terms (pet custody, tax filing, etc.)

If you agree on everything, you don’t need attorneys, hearings, or trials. You just need accurate paperwork.

The Step-by-Step Process

Step 1: File the Petition (Week 1)

The petitioner files: – FL-100 (Petition) – FL-110 (Summons) – FL-105 (UCCJEA Declaration — if children) – MC-030 (Declaration of Venue)

Filing fee: $435

Step 2: Serve Your Spouse (Week 1–2)

Have someone over 18 (not you) personally serve your spouse with the petition and summons. File the Proof of Service (FL-115).

The 6-month clock starts on the date of service.

Step 3: Response or Default (Week 2–6)

Your spouse has 30 days to respond: – Files a Response (FL-120): Both parties are participating — proceed to disclosures – No Response: You can proceed with a default judgment after 30 days

Step 4: Exchange Financial Disclosures (Month 1–2)

Both spouses exchange: – FL-140 (Declaration of Disclosure) – FL-142 (Schedule of Assets and Debts) – FL-150 (Income and Expense Declaration)

Step 5: Sign the Marital Settlement Agreement (Month 2–3)

Finalize and sign your marital settlement agreement — the document that spells out exactly how everything is divided.

Step 6: Submit the Judgment Package (Month 3–5)

File your judgment package: – FL-180 (Judgment) – FL-170 (Declaration for Default/Uncontested) – FL-190 (Notice of Entry of Judgment) – Signed marital settlement agreement – All attachments (custody, support, property)

Step 7: Divorce Finalized (Month 6+)

Once the 6-month waiting period expires and the court processes your judgment, you receive the stamped FL-190 confirming your divorce is final.
