How to Modify a Custody Order in California

Custody orders aren’t set in stone. When circumstances change, either parent can petition the court to modify the custody arrangement.

When Can You Modify?

You need a material change in circumstances since the last order. Common qualifying changes:

  • ✅ Parent relocating (moving away)
  • ✅ Child’s needs have changed (age, school, medical)
  • ✅ Parent’s work schedule changed significantly
  • ✅ Substance abuse concerns
  • ✅ Domestic violence or safety concerns
  • ✅ One parent consistently violating the current order
  • ✅ Child’s preference (if old enough — typically 12+)
  • ✅ Parent is incarcerated
  • ✅ Change in living situation

The Process

Step 1: File the Motion

Step 2: Serve the Other Parent

Serve all filed documents at least 16 court days before the hearing (add 5 days for mail service).

Step 3: Mandatory Mediation

In most California counties (including LA), both parents must attend child custody mediation through Family Court Services before the hearing. The mediator tries to help you reach agreement. If you can’t agree, the mediator may provide a recommendation to the judge.

Step 4: The Hearing

If mediation doesn’t resolve the dispute: – Both parents present their case – The judge considers the changed circumstances – The judge applies the best interest of the child standard – A modified order is issued

Tips for a Successful Modification

  1. Document everything — Keep a log of violations, incidents, and communications
  2. Focus on the child — Frame everything in terms of the child’s best interest, not your preferences
  3. Don’t withhold custody unilaterally — Follow the current order until it’s modified
  4. File promptly — Don’t wait months after the change occurs
  5. Be specific — Request a specific schedule, not just “more time”
