At-Fault Grounds (Tenant Did Something Wrong)
1. Nonpayment of Rent
The most common eviction reason. The tenant failed to pay rent on time. – Notice required: 3-Day Notice to Pay or Quit – Key detail: Only the actual rent amount — no late fees or other charges
2. Lease Violation
The tenant violated a material term of the lease — unauthorized pets, subletting, excessive noise, business operations in a residential unit, etc. – Notice required: 3-Day Notice to Cure or Quit (tenant gets a chance to fix it) – Key detail: The violation must be specifically prohibited in the lease
3. Nuisance
The tenant’s behavior substantially interferes with other tenants’ quiet enjoyment or is destructive to the property. – Notice required: 3-Day Notice to Quit (no opportunity to cure for serious nuisance) – Key detail: Document the nuisance thoroughly — complaints from neighbors, photos, police reports
4. Illegal Activity
The tenant is using the property for illegal purposes — drug manufacturing/dealing, prostitution, gang activity, etc. – Notice required: 3-Day Notice to Quit (no opportunity to cure) – Key detail: Criminal conviction is not required — evidence of illegal activity is sufficient
No-Fault Grounds (Not Tenant’s Fault)
5. Owner Move-In
The landlord or an immediate family member intends to move into the unit. – Notice required: 60-Day Notice – Key detail: Under AB 1482 and LARSO, you must provide relocation assistance (typically one month’s rent). The owner/family member must actually move in and stay for a specified period.
6. Withdrawal From Rental Market (Ellis Act)
The landlord is permanently removing ALL units in the building from the rental market. – Notice required: 120-Day Notice (or 1 year for elderly/disabled tenants in some jurisdictions) – Key detail: Must withdraw ALL units — you can’t cherry-pick. Significant relocation assistance required.
What Is NOT a Legal Reason
- ❌ Wanting higher rent (beyond what rent caps allow)
- ❌ Wanting to rent to someone else
- ❌ Disliking the tenant
- ❌ Tenant complaints about habitability (retaliatory)
- ❌ Tenant’s race, religion, gender, disability, family status (discriminatory)
- ❌ Wanting to renovate without a specific plan requiring vacancy
