
California has four types of restraining orders, each designed for specific relationships and situations. Choosing the wrong type can result in your petition being denied.
Type 1: Domestic Violence Restraining Order (DVRO)
Use when the person you need protection from is: – Current or former spouse or domestic partner – Someone you dated or are dating – Someone you live with or lived with – A co-parent (someone you have a child with) – A close family member (parent, child, sibling, grandparent, in-law)
Filing fee: Free Forms: DV-100, DV-109, DV-110, CLETS-001 Duration: Up to 5 years (renewable)
The DVRO is the most common type and provides the broadest protections, including temporary child custody and support orders.
Type 2: Civil Harassment Restraining Order (CHRO)
Use when the person is: – A neighbor – A stranger – An acquaintance – A coworker (but not your employer/employee) – A friend or former friend – Anyone NOT in a close relationship with you
Filing fee: $435 (fee waiver available) Forms: CH-100, CH-109, CH-110, CLETS-001 Duration: Up to 5 years (renewable)
The standard for a CHRO is higher than a DVRO. You must show a credible threat of violence OR a pattern of conduct that served no legitimate purpose and seriously alarmed, annoyed, or harassed you.
Type 3: Elder or Dependent Adult Abuse Restraining Order
Use when: – You are 65 years or older, OR – You are a dependent adult (18–64 with disabilities that restrict your ability to carry out normal activities) – You are being physically abused, neglected, financially exploited, or otherwise harmed
Filing fee: Free Forms: EA-100, EA-109, EA-110, CLETS-001 Duration: Up to 5 years (renewable)
This type provides additional protections specific to vulnerable adults, including protection against financial abuse and neglect.
Type 4: Workplace Violence Restraining Order
Use when: – An employee has been threatened, harassed, or subjected to violence – The threat is related to the workplace – Filed by the employer (not the employee — the employee would file a DVRO or CHRO)
Filing fee: $435 Forms: WV-100, WV-109, WV-110, CLETS-001 Duration: Up to 3 years (renewable)
